(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1984-069 <br />INSPECTION DATE: 9/5/03 <br />INSPECTOR'S INITIALS GRM <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division of <br />Minerals and Geology. The Schmaltz Pit is located 1 mile north of US 50 just west of Gunnison, Colorado. <br />An operator's representative was not present at the time of the inspection. <br />The proper sign was noted at the edge of the permit area. The affected area boundarymazkers were not observed and <br />must be installed per the requirements of Rule 3.1.12 (2) that state: The boundaries of the affected area will be <br />mazked by monuments or other markers that aze clearly visible and adequate to delineate such boundaries. The lack <br />ofboundary markers is noted as a~roblem with the corrective action(s) and correction date specified on the last page <br />of this report. There were some t-posts noted along the southern edge, however they did not line up with the map, <br />which is of extreme poor quality and mentioned as an issue below. Materials were piled up south of the sign and <br />appear to be outside the permitted area. <br />The Annual Report Map is the original Exhibit B Map submitted in 1984. The detail of the current disturbance, <br />roads leading into the permitted area and boundaries are insufficient on the map supplied to accurately discern <br />whether the operator has disturbed any areas outside the permit. Per CRS 34-32.5-116 (3), the operator shall submit <br />a map showing the extent of current disturbances to the affected lands, reclamation accomplished to date and during <br />the preceding year, new disturbances that aze anticipated to occur during the upcoming year. None of which has <br />been submitted for quite some time. The lack of a current map is noted as a problem under Records with a <br />corrective action and date noted. <br />An asphalt reject pile and foreign topsoiU overburden was noted within the permitted azea. It appeazs that fill <br />material has been imported to the site for use as structural fill. DMG records do not indicate that the notice specified <br />in Rule 3.1.5 (9) has been submitted for this backfill importation and placement. This issue is listed as a problem <br />under the Mine Plan. Please submit this notice by the correction date specified in the Problems section of this <br />report. <br />Material has been brought on site that appears to be topsoil or overburden that is heavily loaded with sticks and plant <br />materials. The importation of this material is noted above. A bigger issue is whether the materials aze outside the <br />permitted boundaries and off site damage. The location of this material issue is listed as a problem under off site <br />damage. A corrective action and date aze noted at the end of this report. Failure to address this issue may result in <br />the issue being changed from a problem to a Possible Violation, which may include Civil Penalties and /or <br />revocation of the pennit. <br />Current conditions may cause the reclamation bond to be increased. Staff will review the bond after the corrective <br />actions have been submitted so an accurate recalculation can be accomplished. <br />No erosion, sedimentation or stormwater issues were noted at this time. <br />
