•
MINE ID # OR PROSPECTING ID # M-77-129
INSPECTION DATE 6-19-98
INSPECTOR'S INITIALS SSS
footers, which would not feasibly serve any purpose relating to cattle feeding, must be
bonded for removal.
The Division will be calculating the updated reclamation cost estimate in the near future.
A copy of that calculation will be forwarded to the operator at that time.
To address the operator's response to problems listed in the 3-10-98 inspectiop report, the
Division responds:
Problem No. 1 - Settling Pond Access Road
Response acceptable under current conditions.
Problem No. 2 - Wash Plant Settling Pond
Though the wash plant facilities were added to the permit in 1977, the facilities were never
described and no financial warranty was ever submitted for removal of the structures.
Additionally, the settling pond was never permitted to be an excavation nearly 30 feet deep
with near vertical embankments. The Division will include, in the revised reclamation cost
estimate, costs for removal of the wash plant and pipeline, and elope reduction for the
settling pond. The operator will need to submit a revision to the permit to incorporate
details of these facilities, as well as any other non-portable facilities that do not support
the post-mining land use.
Problem No. 3 - Spill Containment
Response acceptable, though the Division highly recommends a much more restrictive
containment basin to minimize required cleanup efforts in the event of a spill.
Problem No. 4 - Revegetation of Stages X, Y, and 1
Though the property is for sale, and currently being considered by the Colorado River
Recovery Proqram, the Division does not consider a potential real estate sale as a valid
reason to delay performing required revegetation of the site as per the approved reclamation
plan. Even if the land was sold, the reclamation requirements would still be in effect.
Therefore, performance of the approved revegetation tasks for these sites are already late,
and must be performed during the fall of 1998 to avoid a possible enforcement action.
NAME Edward M.
