III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on December 12, 2002 by Mike <br />Boulay of the DMG. Robert 5hevling of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were cloudy and windy with some light snow. The majority of <br />the site was snow covered. The dragline was temporazily down in the Yoast South azea while a <br />dozer was working to improve a pad for the dragline. Coal was not being hauled from the mine <br />at the time of the inspection. <br />Roads <br />Haul Roads A, B, and D had not been recently bladed and road conditions were icy and snow <br />packed. Road ditches and road drainage runouts were snow covered. Access to many azeas of <br />the mine site were limited due to poor road conditions. <br />Hydrolo¢ic Balance <br />Sedimentation Ponds 010 was viewed from Haul Road A. Pond 010 was snow covered and did <br />not appear to be holding a significant amount of water. Pond 012 was viewed from above on <br />Haul Road D. Pond 012 was snow covered and was nearly full. Pond 011 could not be accessed <br />due to snow packed road conditions. <br />Slides and Damaee <br />The Haul Road D embankment above Pond 012 was inspected. The embaztlmtent was stable <br />with no problems noted. Below this embankment is the location of a slide that occurred in <br />Mazch of 2000. Although this area was entirely snow covered, the site of the slide appeared <br />stable and there has been no indication of additional movement since April of 2002. <br />
