The problems should be corrected by the
dates given, ~~r they will become possible violations. The possible violations should be
corrected by the dates given to reduce their severity when considered by the Mined Land
Reclamation Beard. The inspector noted on the previous page should be notified of all
corrective actions taken.
PROBLEMS/POSSIBLE VIOLATIONS
AND
CORRECTIVE ACTIONS
CORRECTION
DATE
1) The approved mining plan for the operation indicates that 5/1/00
no mining will. be conducted below groundwater elevation and
materials will. not be removed within at least two feet above
groundwater elevation. The continued visible ponding of water
in two excavated areas within the permit area, however,
indicates that. groundwater may still be exposed by the mining
operation.
The permittee must provide evidence that the remaining areas PB OR PV: PB
of ponded water do not represent groundwater exposed by
the mining operations at the site or comply with the conditions
of the permit and backfill the areas of exposed groundwater to
a point two feet above the level of the groundwater or submit TOPICS: MP, HB
a modification. of the permit that allows the exposure of ground-
water by and curing the mining operation and, if desired, allows
permanent pones to be established in conjunction with final
reclamation of the site.
Although tt.e Division has not completed its re-evaluation
of the sufficiency of the financial warranty, it has reason
to believe that reclamation of mining related disturbance
at the site cculd not be completed with the funds currently
available.
The Division will estimate the current cost of reclaiming the
site. If the Division's estimate indicates that the currently
posted financial warranty is insufficient to complete the
approved reclamation plan, the operator will be so notified,
provided with a copy of the Division's estimate and allowed 60
days to bring the site into compliance pursuant to the
requirements of C.R.S. 34-32.5-117 (4).
CORRECTION
DATE
60 days after notice
any insufficiency
PB OR PV: PB
TOPIC: FNS
.
