A site inspection of the Sprague Red Lyons Quarry was made in response to a citizen complaint received from Marty <br />Gould via Susan Basabe of the Boulder County Land Use Department. (See attached correspondence dated February 17, <br />2005). The complaint alleges the operator has been dumping rubble and fill into an undisturbed canyon outside of their <br />mining permit boundary. Present during the inspection were Neil and Matt Sprague of Sprague Stone Company. <br />2. The inspection revealed that the operator had been placing a minor amount of fill along the roadway near Quarry #2. <br />The rock fill was placed on top of existing rubble and used to create a turnout area as the road is not wide enough to <br />allow two (2) vehicles to pass safely by, and constitutes a safety hazard during winter driving conditions. The operator <br />verified that there was no additional disturbed area created, that the area in question is well within the permitted area, <br />and that there is no special permit needed from Boulder County for such activity. There did not appear to be any <br />significant or additional fill into the undisturbed drainage immediately west of the County Roadway. <br />3. The operator indicated that he would like to widen a strip of the road that occurs within the permit area. The widening <br />project would expand the width of the roadway from 12 feet to 24 feet and would allow fortwo-way traffic. There would <br />be a significant volume of fill material involved in the widening project. The operator also expressed an interest in placing <br />a significant volume of waste rock fill in the undisturbed drainage in the northwest portion of the permitted area, north of <br />Quarry #2 and west of Quarry #1; and also opening up a 4v' quarry excavation in this area. This inspector mentioned <br />that the mining and reclamation permit will first need to be revised, and necessary approvals may be needed from <br />Boulder County Road & Bridge Department. It is unknown at this time whether the permit modification can be processed <br />as a technical revision or permit amendment. The operator indicated that there will be no permitted acreage added and <br />no significant change to the reclamation plan. This inspector indicated that the permit modification request should include <br />a plan view map of the proposed changes, representative cross sectional designs, the acreage and volume(s) of material <br />involved, construction methods, length of road to be widened, assurances of geotechnical stability for all permanent waste <br />rock fill, plans for reclamation of any new quarry excavation, an evaluation of the existing drainage patterns and drainage <br />flows for the new area to be disturbed, proper drainage controls under any new waste rock fill, an evaluation of the <br />impacts to existing trees and shrubs in the area to be disturbed, plans for re-establishment of trees and shrubs, and <br />additional reclamation costs for the new disturbance. (The Division recommends that the operator consult with the <br />Division prior to submittal of such permit modification to determine whether the proposed changes may be processed as <br />either a technical revision or a permit amendment. <br />4.
