A site inspection was conducted to familiarize this inspector with the facilities at the <br />Rex Quarry. The Division is still in the process of evaluating the reclamation cost to <br />complete the reclamation plan and the adequacy of the existing financial warranty. <br />2. The operator has acquired a permit for 400 acres of permitted land and a maximum <br />disturbance of 114.8 acres. The post-mining land use is rangeland. The operator has posted <br />a financial warranty of $100,860 in the form of a Corporate Surety. <br />3. The affected land boundary was not found during the inspection, as required by Rule <br />3.1.12. The Division considers this matter to be a problem and requests that the operator <br />properly identify the affected land boundary within 30 days. Although not required by the <br />Construction Material Rules & Regulations, the Division suggests that the operator also <br />identify the entire 400 acre permit boundary. Attached is a copy of Rule 3.1.12. Please see <br />page 3 for details. <br />4. According to the most recent annual report, the operator has backfilled 5 acres and has <br />graded and replaced topsoil on 2.3 acres. <br />5. A portion of the Rex Quarry permit area contains pre-law disturbance that occurred on or <br />before 1974. The operator is only required to reclaim portions of this area, according to <br />the existing reclamation plan, which have been re-disturbed since the permit was issued. <br />Since the affected land boundary was not marked this inspector could not verify whether any <br />re-disturbance has occurred in this area. However, this matter will be evaluated during a <br />future inspection. <br />6. The reclamation plan specifies that all disturbed slopes will be reduced to a grade of <br />2:1 or less. The pit will be backfilled with sandstone overburden, limestone waste, and <br />other inert materials. Reclaimed slopes will approximate the elevations that existed prior <br />to disturbance. All available topsoil will be salvaged for use in reclamation. According <br />to field measurements taken by the Division during February, 1997 there is sufficient <br />sandstone overburden to backfill the pit to within 20 feet of the surface. (The operator has <br />estimated a total depth of excavation of 30-40 feet). There are no stockpiles of salvaged <br />topsoil; however, the operator has been successful in acquiring "beet dirt", a by-product of <br />sugar beet processing, that is being used along with sandstone overburden to provide a <br />suitable seedbed for revegetation. <br />L& E Contact Address <br />NAME Nathan Barton <br />OPERATOR Pete Lien Sons.
