<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by DMG staff from the <br />Durango Office, 701 Camino Del Rio, Room 125, Durango, CO 81301, phone (970) <br />247-5469. Operations were active during the time of this inspection. Tom Bird or <br />Trent Peterson was not available to accompany the DMG inspector. <br />Mine identification sign and safety signs were posted at the mine entrance. Permit <br />boundary markers were observed. Entrance gate was open. Drainage conveyance <br />swale was intact for the entrancelhaul road. <br />Sediment clean-out for the large sediment pond appeared 50% complete. The <br />perforated invert pipe for the inlet of the primary spillway had been removed for pond <br />maintenance, a small debris screen remained intact for the primary spillway. Water <br />level was well below the inlet elevation of the primary spillway, water depth was <br />visually estimated at 1'. Primary and secondary spillways appeared stable and clear of <br />debris, no discharge noted. Pond embankment appeared stable. Overflow pipe to <br />small sediment pond appeared intact, brush guard was intact, no flow noted. <br />The small sediment pond was holding water, approximately 1' depth, no discharge <br />noted. Primary and secondary spillways appeared stable and clear of debris. Evidence <br />of instability along the pond embankment was not observed. <br />Site appeared stable, no evidence of affected area drainage departing the site. Upland <br />diversion ditches were intact and appeared adequate to function as designed. Debris <br />screens, in the upland diversion ditches, were intact and cleaned of debris. Culverts <br />appeared to be sufficiently cleaned of sediment to function as designed. <br />
