Box 396 <br />Michael B Lnng <br />Del Norte, CO 81132 Dn-isinn Durnn~ <br />RS: REQIIIRED CORRECTIVE ACTIONS FOR YOIIR <br />SAND AND GRAVEL PITS IN RIO GRANDE COIINTY <br />Dear Ms. Benton: <br />As promised, this is a detailed list of the corrective actions you must <br />complete in order to be in compliance with the Mined Land Reclamation <br />Act and the Mineral Rules and Regulations: <br />1) DEL NORTE PIT - M-78-071 <br />a) Operator failed to submit an annual report and fee <br />during 1994. <br />CORRECTIVE ACTION - submit an annual report and fee for <br />1994. This problem has been abated. <br />b) Groundwater exposed to evaporative losses. <br />CORRECTIVE ACTION - submit documentation to the Division <br />resolving the water rights issues. <br />Rio Grande County submitted a letter to the Division, <br />dated September 12, 1995, stating the pit is exempt. <br />The Division sent the Office of the State Engineer a <br />copy of Rio Grande County's letter and asked if the <br />issue was adequately addressed. The Division has not <br />yet received a response from the State Engineer. <br />If you have any documentation to substantiate your claim <br />that the pit is exempt, please send it to me so this <br />problem can be abated. The problem will not be abated, <br />and could possibly become a possible violation, if the <br />Division does not receive confirmation of your claim of <br />exemption or some other documentation resolving water <br />rights issues. <br />COLORADO <br />
