<br />Also, records review indicates that the slump which developed in the South-East <br />section of the East area was rehabilitated in October, 1994. HGCC constructed an <br />interceptor ditch at the interface of the, top of the backfill and natural ground. This <br />ditch runs approximately 500 ft in an Easterly direction into an adjacent <br />(undisturbed) drainage. This disturbance was graded and seeded in October, 1994. <br />The slump itself, however, apparently was not regraded. Because of snowcover <br />inspection of this area was not possible. The Albuquerque Field Office will continue <br />monitoring DMG's handling of this situation. <br />No Ten Day Notices were issued as a result of this inspection. <br />As a final note, OSM has been reviewing the availability of public records as a <br />national priority oversight issue. As noted above, the permit and associated <br />documents for this mine are being maintained at a private office in Steamboat <br />Springs, Colorado (TerriMatrix). The Federal and State regulations require that all <br />records and documents required by Title V of SMCRA be maintained in a public <br />building in the county where the mining is occurring or has occurred. As an <br />alternative, the regulatory authority, in this case DMG, may post a public notice <br />identifying the documents that are available for the public to obtain, at DMG <br />expense, and the procedure for the public to follow to obtain those documents. The <br />Hayden Gulch mine is located in Routt County. <br />A review of records at the Routt County Courthouse revealed the following <br />regarding the Hayden Gulch Permit: <br />No Mining and Reclamation Plan <br />No State inspection reports <br />No State enforcement documents <br />No monitoring records <br />No public notice regarding availability of documents <br />Copies of the following were located: <br />11-23-81 proposed decision and findings of compliance for permit issuance <br />1-23-87 renewal <br />12-10-91 to renew permit <br />Two Technical Revision documents <br />Findings of this review will be forwarded to the Regulatory Program Specialist in <br />the Albuquerque Field Office. <br />
