III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection, conducted by Joe Dudash of the Colorado DMG. No one represented the operator <br />during the field inspection. There had been a recent precipitation event. The site was wet. <br />East Mine <br />The entrance gate was locked. The mine ID sign was up on the gate and contained the correct information. Mine <br />ID signs with the new operator information are being installed along the highway where the permit boundary <br />crosses the public road. The paved haul road, graveled access road and light use roads were all in good <br />condition. Road ditches and culverts were functional. <br />There have not been any changes to the West Ridge waste pile. The diversion ditch and collection ditches had <br />sufficient capacity, The waste pile was well vegetated with no signs of slope instability or erosional gullying. <br />The waste pile terraces were well drained. There was a little standing water in the West Ridge waste pile <br />sediment pond, well below discharge. The pond spillways were operational and the pond embankment was <br />stable. The old waste pile was well vegetated and stable. <br />None of the east mine bench cut slopes and fill outslopes showed any signs of instability. Surface disturbance <br />markers were up around the site. <br />West Mine <br />The backfilled and graded former West Mine facilities bench area was well vegetated and showed no signs of <br />erosional gullying or slope instability. Silt fence and surface disturbance markers were up. The upper sediment <br />pond was dry, while the lower pond had only a little ice in it. Both pond embankments appeared to be stable. <br />Unit Train Loadout <br />All three gated entrances to the loadout were open. Mine ID signs contained the correct information. Paved <br />entrance roads were in good condition. There was a Union Pacific work railcar at the loadout but no other <br />railcars were on site. <br />The collection ditches and culverts at the loadout were functional. The clean water and irrigation water diversion <br />systems were operational as well. There was no water in the sediment pond. The pond spillways were <br />functional. <br />Run-Of Mine (ROM) Stockpile <br />The graveled haul road at the temporarily reclaimed ROM pile was in very good condition. The mine (D sign <br />was up and surface disturbance markers defined the disturbed area. The collection ditches were well vegetated <br />and culverts were clear.
