III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash. No one represented the operator <br />during the field inspection. <br />ROM Area <br />The operator has removed all of the coal that had been screened. Some of the coal was <br />shipped out. The remaining coat was transported to the crusher/screener bench for <br />temporazy storage. The gob material left over from screening was being pushed away <br />from the sides of the area in order to avoid fires from spontaneous combustion. There <br />were no problems with fugitive dust offsite. <br />The ROM area pond was dry. Spillways were functional and pond inslopes and outslopes <br />were stable. The road was in good condition. The mine ID sign was up. <br />East Mine <br />There was no activity at the east mine. The screened coal from the ROM pile was on the <br />crusher/screener bench. There were no problems with fugitive dust. The entrance gate <br />was closed and locked. <br />West Mine <br />The operator has finished the first phase of the reclamation at the west portal bench area. <br />The upper third to one half of the portal bench disturbed area has been completely <br />backfilred, graded and topsoiled. The remaining lower portion of the disturbed area has <br />partial backfilling and grading. The remaining backfilling and grading will take place <br />when the East Roatcap Creek culvert and sediment ponds aze removed. <br />Two new sedimentation ponds have been constructed over the East Roatcap Creek <br />culvert. The operator has not completed the engineering certification work yet for the two <br />new ponds. The original sedimentation pond has been reclaimed. <br />The original entrance road has been backfilled and a berm has been constructed at the <br />former entrance to the site. The operator has left a small access road on the slope east of <br />the creek to facilitate hydroseeding and mulching. <br />c:~rns97/bowie 1 /insp0602 <br />
