(Page 2)
MINE ID # OR PROSPECTING ID #: ~-toy~-(1ST
INSPECTION DATE: e/~~/a~ INSPECTOROS INITIALS: ~-
OBSERVATION
The Division conducted a cursory site visit of the operation in association
with an SO application. The operator Florence Sand and Gravel has submitted
an SO to Florence Sand and Gravel LLC. The only change is the LLC part, it
will be the same operator. As part of the Division's policy to evaluate the
financial warranty for all sites during such revisions, the Division tried
to locate the 1997 conversion application in the imaged documents, but the
application document does not appear to have been imaged. The post mining
land use is listed as Range Land in the DRMS'S PERMIT SYSYTEM.
The Division went on site to look at the file in the presence of Miss Linda
Braco, the office manager. The conversion application was not located but
the Division did find a letter sent to Mr. Mike Markus, City of Florence,
by Lloyd V.Buck Barnhart. In that letter Mr. Barnhart stated that it was a
copy of the letter that was sent to DRMS (DMG at that time) which is the
Master plan for the site.
A) S Acres- Landscaping and retailing, area to be used to store
decorative rocks.
B) 10-acres- Truck equipment sales parking area.
C) 6.1 acres- Present Mining Area.
D) 11.5 acres, the areas not to be disturbed until A, B AND C are fully
mined out.
In the letter Mr. Barnhart stated that, "The main concern with Mr. Ohler's
of DMG is, the final reclamation and the fact that he wants the pit floor
and back slopes seeded with grass. It is our position that this would be
redundant exercise to plant grass and then use the area for truck and heavy
equipment storage and movement. It is zoned Industrial by the City and
should be acceptable use to MLRB. we are proposing to put 6"to12" plate of
sand and gravel on the pit floor for surface and travel area for industrial
uses proposed."
Since there appears to be some confusion as to what the post mining land
use is for the site, the Division requests the operator to provide proof
from the City that the site is Zoned Heavy Industrial, also a copy of the
conversion application that was submitted in 1997,if possible, which
changed the post mining land use from Range Land to Heavy Industrial. Once
the Division receives the requested information, there might be no need to
adjust the financial warranty and the post mining land use will be changed
as approved in the Amendment in 1997. The Division appreciates in advance,
the help the operator will provide in resolving this matter.
