III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on February 14, 2006 by Mike <br />Boulay of the DMG. Leonard Shearer of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were cleaz, windy, and cold. The mine site was snow covered. <br />Coal production has ceased at the mine. A temporary coal stockpile remains at the site located to <br />the north of the Explosives Storage azea. Coal was not being hauled from the mine at the time of <br />this inspection. <br />Availability of Records <br />All required records were on file and available for review at the mine site office. No problems <br />were noted with the records review. See the attached Availability of Records checklist. <br />Roads <br />Haul Roads A and B were cleaz of snow and frozen hazd at the surface. These haul roads were <br />well maintained. The road into the former Wolf Creek pit azea has been blocked with spoil <br />material and was inaccessible. All ditches and culvert inlets and outlets along Haul Roads A and <br />B were snow covered. Haul Road D and the North Pit area were not accessible due to drilled <br />snow. <br />Hydrolopic Balance <br />Sedimentation Pond 010 was viewed from Haul Road B, and Ponds 012, 013, and 014 were <br />viewed from the County Road along Sage Creek. The surfaces of these ponds were frozen and <br />snow covered. The water level in Pond 010 appeazed to be below the principal spillway. Pond <br />012 was full and discharging a small amount of cleaz water. Ponds 013 and 014 were not <br />dischazging. Pond inlets and embankments at all sediment ponds were snow covered. No <br />problems were noted at any of these sediment pond locations. Pond 011 was not accessible due <br />to drifted snow and icy conditions on the access road. <br />The lower Armand Draw drainage was inspected. The drainage was not accessible due to <br />approximately three feet of snow cover. The rock check dams were snow covered but appeared <br />to be in place and in good condition. <br />
