RE: Additions and deletions of acreage where no disturbance has occurred - Revision to
the policy adopted May 31, 1996 -REVISION TO THE 9/18/98 MEMO
This Policy may be applied where an operator wants to add new acreage by deleting undisturbed acreage
from either the permitted area or affected area. This policy is applicable to any permit that tray be atnetrded.
Procedure:
The following conditions mast exist:
- The area to be deleted from the permitted area or affected area must not have been
disturbed by the existing mining operation or any previous operazor where a suceessian
of operators has occurred. The area to be added must not have been disturbed by the
operator.
- The existing reclamation plan, post Honing land use, and financial warranty amount are
appropriate and adequate for the area to be added.
- If an exchange were to occur, the total new acreage must not exceed the amount deleted
or released.
The following process shall be followed:
- The operator shall submit a standard request for a reclamation liability release. The
release of the area to be deleted from the current permit or affected area needs to occur
prior to atttendment approval.
- The operator shall submit a completed amendment application form. The form must
include all applicable exhibits. It is the responsiblllty of the EPS asstgned the case to
ensure at all appropriate exhibits are part of the application prior to the Division's
approval or recommendation for approval. The normal amendtnem application fee
will not initially be requited. However, the operator must submit the standard fee
required for a technical revision. The operator shall notice according to the standard
notice requirements for a permit amendment. If the Division receives a timely objection
to the applicazian, the operator shall be notified and required to provide the remainder of
the standard fee for a permit amendment as soon as possible, but prior to the Division's
recommendation. It the required standard fee is not received by the Division's
recommendation date, the Dtvisfon shall recommend that the applicatlon be denied.
Thts policy is not applicable and can not be used as a method to correct an existlng or potential
violation.
