III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during [he <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on Apri122, 2004 by Mike Boulay and <br />Jim Stazk of the DMG. Roy Karo of Seneca Coal Company and Jay James of Montgomery <br />Watson Harza were present during the entire inspection. Weather conditions were cloudy and <br />cold. It was not snowing at the time of the inspection. Ground conditions were very wet and <br />muddy and the site was partially snow covered. South facing slopes were mostly free of snow <br />cover. Coal was being hauled from the South Area pit at the time of the inspection. The dragline <br />was operating in the Yoast South Area and two dozers were backfilling and grading a portion of <br />the South Area pit. <br />Hydroloaic Balance <br />Sedimentation Ponds 010, 013, and 014 were inspected. Pond 010 was full and dischazging clear <br />water. Pond 013 was neazly full to a level approximately one foot below the top of the principal <br />spillway. Pond 014 was also retaining a significant amount of water but was not dischazging. <br />Pond embankments were stable and no problems were noted at any of these sediment pond <br />locations. <br />Road cuttings have been stockpiled on the road crossing for Armand Draw. The cuttings were <br />saturated and the North Area pit was not accessible. Work was underway at this location to dry <br />out and transfer the cuttings to an active pit for disposal. As noted in the previous inspection <br />report (dated 03/29/04) runoff from Post Mine Channel YPM-10 exited the channel and caused <br />rills and gullies to form near the lower end of the channel. SCC has initiated work at this <br />location to repair the erosion. To ensure compliance, please complete the repairs at the Post <br />Mine Channel YPM-10 as soon as ground conditions dry out and allow for full access to this <br />location. <br />Backfill & Grading, Topsoil, and Reve etg ation <br />Cessation Order CO-2003-012 is pending (please refer to previous inspection reports dated <br />October 2003 through Mazch 2004). The remaining location for which the cessation order <br />applies is the area designated for backfill and grading in 2001-2002 as shown on the Exhibit 19- <br />lA in the permit application package. Backfill and grading has been completed at this location, <br />and the re-graded azea appeazs stable with no significant erosion noted at the time of this <br />inspection. Topsoil redistribution and seeding remains to be completed at the 2001-2002 azea. <br />Open and/or active pit azeas were inspected to determine current worse case disturbance at the <br />mine site. Open pit azeas include: the South Pit, the West Extension Area, the Valora South Pit, <br />and a small portion of the Neck Area Pit. SCC has an approved variance for a delay in <br />
