III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on November 2, 2005 by Mike <br />Boulay of the DMG. Dennis Jones of Seneca Coal Company (SCC) was present during the <br />inspection. Weather conditions were sunny, cool, and windy. The site was mostly dry. With <br />exception of the shop and facilities area, there was no activity at the mine site at the time of the <br />inspection. <br />Roads <br />Access roads site wide were mostly in good condition and maintained. Road El has been <br />narrowed along a significant section in accordance with the proposed permanent road plan. Road <br />E (access to the PECOCO Pond) has also been narrowed in one section between the Wadge <br />Impoundment and the PECOCO Pond since the time of the last inspection. Some minor erosion <br />and rutting of road surfaces is occurring due to hunter access. Rills are beginning to form on the <br />surface of Road C in isolated locations. Please continue to maintain roads site wide. <br />Hvdroloeic Balance <br />The erosion previously noted at PM-23 has been repaired. A deep hole or fissure had formed in <br />the channel of PM-23 above the junction with PM-2. The hole has been backfilled and graded. <br />Two holes have formed in the regraded area by a badger or other animal burrowing. The holes <br />were backfilled by hand during the inspection to reduce further erosion. This channel may <br />require additional armoring to prevent further erosion at this location. A track hoe was utilized at <br />PM-23 to do the repair. If necessary, please reseed the tracked area at this location to ensure <br />stability and revegetation of this area. <br />Site Sedimentation Ponds 002, 003, 004, 008, and the PECOCO Pond were inspected. All of <br />these ponds were discharging cleaz water. Pond 008 had a leak in the discharge pipe on the <br />backside of the embankment since it was recently installed. The leak was repaired and the <br />embankment regraded. It appears that the location of the repair should be reseeded. All pond <br />embankments were stable and no problems were noted at any of the pond locations. <br />Revegetation <br />Overall, reclamation at the site looks good with well-established vegetation. Grasses were <br />beginning to turn brown throughout the site. Some rills are present in the Upper Wolf Creek <br />Area above Stock Pond T-32. <br />
