III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />durng the inspection Comments also describe any enforcement actions taken during the rnspec6on <br />and the facts or evidence supporting the enforcement actwn, <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine is in permanent cessation and <br />reclamation of most areas is complete. Ground conditions were dry and the weather was <br />mild and breezy <br />Availability of Records <br />The public copy of the mine records is kept at the Energy Fuels Coal Company office in <br />Florence The rnspector hand carried a copy of the 4'" quarter 2006 pond and refuse pile <br />rnspecUons to the Division's office. Specific detail regarding the records inspection can be <br />found on page 2a of this report. All other records were found in compliance. <br />Roads <br />The road flanking the main facility reclamation appears to have held up well this winter The <br />surface was smooth with no rutting and the water bar crossings were in good condition and <br />passable without sigrnficant roughness. <br />Hydrologic Balance <br />Ponds 4 and 5 continue to remain dry. even following significant winter snowmelt and sprang <br />rain. The Magpie creek diversion channel continues to be very stable and more than <br />adequate in size to handle large runoff events. The two ponds at the loadout were also dry <br />and appeared normal and functional. <br />Revegetation <br />Revegetation at the loadout is <br />comprised of annual weeds. <br />shrubs, and mostly warm <br />season grasses (photo right). <br />Last years growth remains <br />standing but these grasses <br />have yet to show much growth <br />this year due to cool soil <br />conditions <br />Vegetation at the main facility <br />area is beginning to come on <br />for the season. Cool season <br />grasses and fortis were <br />observed. Grazing by a small <br />
