(Page 2) • <br />MINE ID # OR PROSPECTING ID # M-84-099 <br />INSPECTION DATE June 5. 1998 INSPECTOR'S INITIALS TAS <br />OBSERVATIONS <br />1. A site inspection was made at the request of Mr. Rex Fletcher of the Omaha District, U.S. <br />Army Coxes of Engineers. The purpose of the inspection was to discuss the resolution of an <br />existing Section 404 violation. Present during 'the inspection were Mr. Fletcher of the COE, <br />Rick Huff of Hall-Irwin Construction Co., and Steve O'Brian of Environment, Inc. <br />2. The site inspection revealed that the operator is in compliance with the approved mining <br />and reclamation plan, in spite of a pending Section 404 violation. The area of violation <br />occurs in the southern portion of the permit area along the north and south banks of various <br />sections of the St.Vrain Creek. St.Vrain Creek had severely eroded a number of banks within <br />the permitted area during previous high flow events. In response, the operator had applied <br />riprap to stabilize the eroded banks. The repair work, unfortunately, was done without prior <br />approval of a Section 404 Permit. Since then, the Corps of Engineers has issued a Section <br />404 Permit to the operator which requires that the banks be stabilized and that wetlands <br />vegetation be replanted. <br />3. In order to resolve the 404 Violation, the operator will need to reconstruct the banks of <br />St.Vrain Creek in several places to allow for establishment of wetland vegetation. Mr. Huff <br />and Mr. O'Brian were advised that such a change to the existing slopes and reclamation, <br />within the M-84-099 permitted area, can be permitted under the terms of a technical revision. <br />The technical revision application should include a map of the area(s) to be reconstructed, <br />a representative schematic of the work to be done, the size of riprap to be used, an estimate <br />of the number of linear feet of bank to be reworked, and a unit cost/linear foot for the <br />reconstruction work. <br />4. The approved mining plan requires that the operator maintain a minimum setback distance <br />of 100 feet from the water line of St.Vrain Creek.
