III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Continents also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on October 23, 2002 by Mike <br />Boulay of the DMG. Lori Smith of Seneca Coal Company was present during the inspection. It <br />was snowing at the time of the inspection and ground conditions were wet throughout the mine <br />site. Coal was not being hauled from the mine site during this inspection. <br />Availability of Records <br />All required records. were on. file. and available for review at the mine. site office_ No problems <br />were noted with the records review. Please see the attached Availability of Records checklist. <br />Roads <br />Road surfaces were muddy and partially snow covered. The actide pit area could not be accessed <br />due to very muddy and slick road conditions: Flanl Roads A and B wereaccessible, and a portion . <br />of Haul Road D was accessible up to the location of Culvert D-4. Water was flowing in road <br />ditches and road drainage runouts along these sections of haul road. Culverts along Haul Roads <br />A, B, and D were clear of sediment and debris and functioning properly. <br />Hydrologic Balance <br />Sedimentation Ponds 010, 011, 012, and 014 were inspected. Ponds 011, 012, and 014 were <br />retaining water, but none were dischazging. The cleaning of Pond 010 has just been completed. <br />The pond has been resurveyed to ensure that an adequate amount of sediment has been removed_ <br />SCC has no yet assessed the resuhs of the survey. The temporary access road that was built for <br />hauling the sediment from the pond has been reclaimed. Pond 010 was holding a very small <br />amount of water. <br />Ponds -011, 012, and 014 were retaining water but were not discharging. Damage that occtitred <br />to the Pond 011 inlet in August has been repaired. Anew liner and riprap have been installed at <br />the pond inlet channel. Pond inlets and embanlanents appeaz stable and no problems were noted <br />at any of the pond locations. <br />Revegetation <br />During the last inspection (September, 2002), the DMG requested that SCC seed all azeas in the <br />North Pit that have been topsoiled. The access road into the North Pit was not passable due to <br />saturated ground conditions. However, SCC personnel indicated that seeding has been <br />completed for those areas in North Pit that have been topsoiled. <br />
