III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This aerial inspection was flown on February 7, 2003. There were no compliance <br />problems observed during the overflight. The digital images were reviewed on February <br />14, 2003. The snow cover was complete at the higher elevations and only partial at the <br />lower elevations. There was no activity observed onsite. <br />Train Loadout <br />There was partial snow cover at the loadout, although the roads and most other open <br />azeas on the bench levels were cleaz. The pond was mostly cleaz of snow. There were no <br />signs of erosional gullies on the bench outslopes. All of the roads appeazed to be <br />passable: No problems with any of the facilities were observed. All three entrance gates <br />appeazed to be open but no coal haul trucks or train railcazs were on site. <br />ROM Pile <br />The run-of--mine (ROM) pile was completely covered in snow, including the sediment <br />pond and the haul road. There was some mine equipment in one corner of the material <br />storage azea. <br />West Mine <br />The West Mine was completely covered in snow, including the sediment ponds and all <br />roads. No problems with slope or sediment pond embankment instability were observed <br />at the West Mine reclaimed portal bench azea and at the fan site azea. <br />East Mine <br />The paved haul road was cleaz of snow and appeazed to be passable. The dirt road was <br />snow covered, as were the benches. Bench outslopes and the portal bench highwall were <br />generally clear of snow. There were no problems with slope instability with any of the cut <br />and fill slopes and at the West Ridge Waste Pile. The sediment pond at the West Ridge <br />Waste Pile was covered in snow. <br />c: \word\b owi e 1 \insp0203 . <br />
