<br />MINE ID # OR PROSPECTING ID#: M-1990-098 PAGE: 4 <br />INSPECTION DATE: 10-9-O1 INSPECTOR'S INITIALS: ACS <br />discussion and guidance for permitting and reclamation of floodplain pits. <br />Finally, the 9/21/01 letter states that the "appropriate authority for <br />resolution of floodplain issues at this property is the floodplain ordinance <br />of the local jurisdiction." The Division of Minerals and Geology is required <br />to review permit applications and assure that the proposed mining and <br />reclamation plans will minimize impacts to the prevailing hydrologic balance <br />and will be preventive of offsite damage. The Division's review is at the <br />state government level, and decisions made by the Division or by the Mined <br />Land Reclamation Board due not relieve applicants or permittees from <br />requirements to obtain and comply with any other needed federal, state, or <br />local permits or licenses. Nor does an Operator's possession of other permits <br />change the way the Division reviews a mined land reclamation permit <br />application. The Division supports the use of information for permitting or <br />mining and reclamation planning collected for other agency's permits and than <br />used in support of a mined land reclamation application, but does not <br />generally abdicate regulatory authority to other agencies.
