(Page 21 <br />MINE ID # OR PROSPECTING ID # M-1990-025 <br />INSPECTION DATE 8/19/02 <br />INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection occurred as part of DMG review of an amendment application (AM-01) to expand the permit <br />area and change the name for the Gardner Pit No. 2A. Under AM-01, the operation name will be changed to <br />the Hay Camp Pit and permit area increased to total 460 acres. Portions of the 374 acres addition include <br />the entire permit area for the Gardner Pit, Permit No. M-1985-172, issued to Montezuma County. The <br />amendment application for the Gardner Pit No. 2A indicates that Montezuma County has entered an agreement <br />with Four States Aggregates, addressing the continuation of. Montezuma County mining activities within the <br />amended permit boundary proposed by Four States Aggregates. <br />The Act and Rules do not appear to prohibit an operator from permitting lands already permitted to a different <br />operator, providing the new operator submit an adequate permit application which demonstrates legal right <br />of entry to conduct mining and reclamation activities. However, DMG approval of AM-O1 to the Gardner Pit <br />No. 2A does not imply automatic termination of the Gardner Pit, issued to Montezuma County. Subsequent <br />to DMG's approval of AM-01, termination of the Montezuma County permit would be appropriate because <br />reclamation of the county permit area is guarantied under another permit. However, Montezuma County will <br />remain the permit holder and responsible for compliance with permit conditions and the Act and Rules for the <br />Gardner Pit until Montezuma County requests termination of its permit. <br />Permit History: The original 110c permit was issued on 5/22/90 to Blasting & Mining, Inc., for 9.9 acres <br />affected area, financial warranty set at 55,000. On 10/19/95, the Board issued Notice of Violation MV-95- <br />071, for mining beyond the approved permit boundary. Corrective action for MV-95-071 was to convert the <br />110c permit to a 112c permit to include all lands affected by the mining activity. On 11/16/95, DMG <br />approved conversion of the permit to a 1 12c permit (CN-01), for 87.62 total acres, financial warranty <br />increased to 562,070. On 3/3/99, DMG approved transfer of permit for Hay Camp Gravel, Inc., as successor <br />operator (SO-01). Under SO-01, cost of reclamation was calculated at 557,001, however, the amount of <br />financial warranty remained at 562,070. On 9/25/00, the operator withdrew a request for release of 5.03 <br />acres affected area (AR-01). On 12/1 /00, DMG approved transfer of permit for Four States Aggregates, LLC, <br />as successor operator (SO-02), financial warranty approved at 562,000. On 7/18/01, DMG approved release <br />of 6.0 acres (AR-02) for completion of reclamation. Under AR-02, permit acreage was reduced from 87.62 <br />acres to 81.62 acres. <br />Permit Area: Mine identification sign was posted. Boundaries of affected lands were delineated. Mining and <br />reclamation activities appeared to be occurring in accordance with permit conditions and the Act and Rules. <br />The approximate 374 acre expansion area appeared consistent with the descriptions provided in the AM-01 <br />application.
