.~ T <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Coal Gulch Mine for the month of November, 1998. <br />Hydrologic Balance: The pond had water in it but was not discharging. The primary spillway is <br />covered with fill material and is no longer functional. The emergency spillway might work but the <br />old channel is totally cover with rocks arid topsoil. Coal Gulch Creek is still open to flow, but <br />since the channel was reconstructed by FireHawk Construction, It is doubtful that it can handle a <br />25 year event. <br />Reclamation Success: The site is well vegetated and stable as far as erosion is concerned. <br />General Mine Compliance: Firehawk Construction Company continues to push the limit of their <br />property boundaries for their topsoil storage/ trash burning operation. To date, no outcries from <br />the public nor the other landowner has been recieved by either the Denver or Durango offices. <br />More construction material and junk is being stored at the site. <br />
