.. <br />Mr. David King <br />4 <br />1 1 /4/95 <br />1 .13.712) The Board shall, when necessary, establish the commencement of Temporary <br />Cessation to determine the start of the five 151 year period described in Subsection <br />1.13.8. <br />SUMMARY <br />TR-01 , as submitted in the application letter dated 10/30/95, is not adequate for DMG approval. <br />DMG adequacy concerns stated in this letter include the following: <br />1. Provide the information listed in Rule 1.13.5121, as required by Rule 1.13.7(1); <br />1.13.5(2) The Notice of Temporary Cessation for the initial period shall include the <br />following: <br />lal the date of cessation; <br />(bl the reasons for non-production or cessation of the mining operation; <br />(c) a plan for resumption of mining; <br />Idl the measures to be taken to comply with reclamation requirements and/or <br />other activities related to the performance standards of section 3.1 while the <br />mine is in Temporary Cessation; and <br />lel demonstration that the existing Financial Warranty is adequate to cover the <br />reclamation liability. <br />2. Address how operator will satisfy the conditions for substitution for Notice of TC, as <br />listed under Rule 1.13.7(111a). <br />13.71111a1 The Operator must report to the Board through the Annual Report: <br />(il the condition of the operation at the time of cessation; <br />(ii) what specific measures have been and will be implemented to comply with <br />reclamation and performance standards requirements; and <br />(iii) plans for resumption of mining. <br />All previously submitted Annual Reports, required by Rule 1 .1 5, may be in error in that <br />the submitted Annual Reports state 0 acres have been affected and that mining <br />operations have not commenced.
