s <br />Mr. David King <br />2 <br />1 1 /4/95 <br />DMG records indicate that this request for TR is the first revision to the Wallace Pit permit, as <br />such, DMG shall process this application as TR-01. TR-01, as submitted in the application letter <br />dated 10/30/95, is not adequate for DMG approval. The balance of this letter will address <br />adequacy concerns for the submitted application for TR-01 . <br />The issue identified in PB 4 of DMG 8/30/95 inspection report may be associated with the TC <br />issue identified in PB 5. As such, DMG has determined that PB 4 may be more appropriately <br />addressed as an adequacy concern of TR-01, rather than pursuing PB 4 with additional <br />enforcement action at this time. <br />TR-01 ADEQUACY CONCERNS <br />Rule 1.9.1 of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board, <br />states that DMG will act on a TR application within 30 days of filing and that a TR shall be <br />automatically approved within 30 days after filing unless the application is denied. TR-01 was <br />found complete for the purposes of filing on 10131/95. As required by Rule 1.9.1, DMG <br />decision due date is 1 1 /29/95. Timely response from the operator, addressing the adequacy <br />concerns listed below, are necessary to allow DMG to approve TR-01 by 1 1 /29/95. <br />Rule 1 .13.711) states that TR-01 shall contain the information required by Rule 1.13.5(21. <br />1 .13.512) The Notice of Temporary Cessation for the initial period shall include the following: <br />lal the date of cessation; <br />Ib) the reasons for non-production or cessation of the mining operation; <br />Ic) a plan for resumption of mining; <br />Id) the measures to be taken to comply with reclamation requirements and/or <br />other activities related to the performance standards of section 3.1 while the <br />mine is in Temporary Cessation; and <br />lel demonstration that the existing Financial Warranty is adequate to cover the <br />reclamation liability. <br />Please provide the information listed in 1.13.5(21, as required by 1.13.7(11. <br />Rule 1 .1 3.711) also states that TR-01 shall serve as a substitute for the Notice of Temporary <br />Cessation as described under Paragraph 1 .13.512) with the following conditions: <br />lal The Operator must report to the Board through the Annual Report: <br />li) the condition of the operation at the time of cessation; <br />(ii) what specific measures have been and will be implemented to comply with <br />reclamation and performance standards requirements; and <br />(iii) plans for resumption of mining. <br />Please address how the operator will satisfy the conditions for substitution for the Notice of <br />Temporary Cessation, as listed above under 1 .13.71111a). <br /> <br />Annual reports submitted by the operator since permit issuance state that operations have not <br />commenced, yet observations recorded in DMG inspection report from the 8/30195 inspection <br />indicate that vegetation has been stripped, topsoil stockpiled, and minor stockpiling of material <br />
