The following problems (PB) and/or possible violations (PV) (and suggested corrective
actions) were identified during this inspection. The problems should be corrected by the
dates given, or they will become possible violations. The possible violations should be
corrected by the dates given to reduce their severity when considezed by the Mined Land
Reclamation Board. The inspector noted on the previous page should be notified of all
corrective actions taken.

The reclamation plan does not adequately address protection of
the lateral berm in the event of a flood between the East Rigden
Pit (Permit No. M-1979-097) and the Port of Entry Pit (M-1982- PB or PV:PB
182) from slides or damage as a result of the mining or TOPIC(S):SG
reclamation operations. Under the Construction Material Rules 03-01-04
and Regulations, areas outside of the affected land shall be
protected from slides or damage occurring during the mining and
reclamation operation (C.R.S. 34-32.5-116 (4)(i)].
CORRSCTIVB ACTION:
The operator will need to file a revision to the permit to
adequately address stability of the lateral berms where
floodwaters enter and leave the East Rigden Pit. Revision must be
submitted by March 1, 2004.
The mining and reclamation plan does not address the construction pg or PV:PB
and reclamation of a low-water crossing across the La Poudre River TOPIC(S):BB
to access the Baumgartner parcel. 03-01-04
CORRBCTIVB ACTION:
A Technical Revision to the permit must be filed addressing the
installation and reclamation of the low-water crossing. Submittal
of this revision is due on March 1, 2004.
