III. COMMENTS -COMPLIANCE ~Qirp / C~~ C~3 "~~1 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Terror Creek Loadout. The inspection was <br />performed by Jim Stark of CDMG. This was also a bond compliance inspection, <br />where buildings and other facilities were measured to be compared with information <br />in the permit and reclamation cost estimate. No representative from Terror Creek <br />accompanied me on the inspection, however, Jim Keiger of OMI was present for the <br />records check. The loadout is active and during the inspection trucks were dumping <br />coal at the truck dump, the crushing and screening "plant" were operating and a <br />train was being loaded. The weather was hot and sunny and the ground was dry. <br />Availability of Records: All of the necessary records were available at the Sanborn <br />Creek Mine office and the Terror Creek Loadout office. Terror Creek was in the <br />process of moving the records from the loadout office to the Sanborn Creek Mine <br />office at the time of the inspection. For more detailed information please see the <br />records checklist at the end of this inspection. <br />Signs and Markers: The mine identification sign at the entrance to the loadout was <br />incorrect. I was informed by Jim Keiger of OMI that they were in the process of <br />having a new sign made. All of the other signs including topsoil stockpile signs and <br />permit boundary signs were in place and were in good condition. <br />Roads: The access road to the loadout is a paved road. This road was in good <br />condition. <br />-The haul road from the truck scale to the truck dump and out of the loadout was <br />also in good condition. <br />- The light use road from the truck scale to County Road 4365 was also in good <br />condition. <br />Hydrologic Balance: The sediment pond was dry at the time of the inspection. The <br />pond was well vegetated and in good condition. <br />-The ditch leading to the sediment pond was also well vegetated and in good <br />condition. <br />- Diversion ditch "A'" and diversion ditch "B" were also well vegetated and in good <br />condition. <br />- All of the culverts appeared to be clear and functioning properly. <br />Topsoil: Both of the topsoil stockpiles (1 and 2) were marked and well vegetated. <br />There did not appear to be any erosional problems on either of the piles. <br />Air Resource Protection: Although there was a small amount of coal dust being <br />generated from the crushing and screening and loading processes, it did not appear <br />that any of this was leaving the site. <br />
