III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or __ <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on November 12, 2003 by Mike <br />Boulay of the DMG. There were no representatives from Kerr Coal Company present during the <br />inspection and there was no activity at the site. Weather conditions were cloudy and cold. [t had <br />snowed at the site on the day prior to the inspection, and ground conditions at the site were wet <br />and partially snow covered. <br />Roads <br />The permanent light use road that accesses the surface facilities area was muddy and partially <br />snow covered. Access to the site was very limited due to the poor road conditions. Perimeter <br />areas at the site were well maintained and no problems were noted. <br />Hvdrologic Balance <br />Sedimentation Ponds E, F, and G were inspected. Pond E was retaining water at a level <br />approximately 2-3 feet below the primary spillway. The surface of this pond was frozen. Ponds <br />F and G were dry. No problems were noted at any of these pond locations. <br />
