III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />ReveQetation <br />At the start of the inspection, we drove to the western end of the permit azea to inspect the pre- <br />mining condition of several parcels of undisturbed land. We parked at the intersection of the <br />James Johnson, Lloyd, and Morgan properties and briefly inspected each area (see attached <br />Photograph No. 1). Pre- and post-mining land uses for each parcel is designated as irrigated <br />pasture. The Lloyd properly to the northeast of the intersection has remnants of irrigation ditches <br />that no longer appear to be in use (Photograph No. 2). The Lloyd property is predominantly sage <br />brush with rocky outcrops at the surface in some azeas. Topsoil depths appeazed somewhat thin <br />and variable. Cactus and Red-Stem Fillery were also noted at the Lloyd property. The Morgan <br />property to the south as shown in Photograph No. 3 has two very different appearing irrigated <br />pasture lands separated by a fence. To the west the pasture is irrigated with Side Rolls and <br />appears to be in good condition and well established. To the east the irrigation has been on/off <br />resulting in brown, dry conditions and the growth of knapweed. On the James Johnson land west <br />of the Lloyd property, the site is imgated with gated pipe. As seen in Photograph No. 4 the <br />gated pipe sits on a ridge. The land above the gated pipe is in worse condition with browner, <br />drier conditions and overall less cover than the azea below the gated pipe that receives the <br />irrigation water. As demonstrated here, in one relatively small azea of the mine site a variety of <br />conditions and vegetation types exist within the irrigated pastures seen in these tracts of land. <br />
