The <br />company has been quite diligent in getting these items resolved as rapidly as possible. <br />Although 1 don't have pictwes yet, Gary Reed assures me that the mazking of the permit boundaries <br />has been completed. They moved equipment in about March 20, and have done what looks like an <br />acceptablejob reclaiming the slopes on the north end, in the azea mined by others. They have been <br />able to backslope a pazt of it at 3H: ] V. <br />As you stated in your letter of Mazch 11, 1999, the topsoil adequacy issue has not been resolved since <br />the proposed 112 permit amendment altering the post-mining land use and reclamation needs has not <br />been submitted. My instructions are to prepare a 112 amendment to this permit and to have it <br />submitted a[ the same time [he Main Pit amendment is submitted. I will make every effort to <br />accomplish this, and feel that the topsoil adequacy issue will be resolved then. <br />March 1, 1999 you sent a Division estimate of cost of reclamation for this operation. With the <br />proposed amendment to a 112 permit with reclamation being as per the grandfathered industrial use, <br />the reclamation costs will be substantially different. Also, a large part of the backsloping costs have <br />been eliminated by the work that has already been done. We would request that determination of the <br />Financial Warranty be held in abeyance and determined with the 112 Permit. <br />"Your Brand of People" <br />
