(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-085 and M-2006-032 <br />INSPECTION DATE 10/26/07 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />On July 24, 2006, the Division approved the application for the Bellgardt Pit, M-2006-032. The Division <br />did not receive an appropriately executed Financial Warranty within 365 days of its approval date forthe <br />application. Therefore, pursuant to Construction Materials Rule 4.1(2), the Division must schedule the <br />application for consideration by the Colorado Mined Land Reclamation Board (the "Board"). However, <br />prior to the Board's consideration, the Operator must renotice the application and the Division must <br />conduct an inspection to verify that no mining has occurred as well as to record any observations that <br />may be of interest to the Board, per the requirements of the Minerals Program Policy Memo, December <br />12, 2002, revised June 15, 2006. <br />The application for the Bellgardt Pit, M-2006-032, described a standard 112 type construction materials <br />operation, which would incorporate all lands previously permitted under M-1977-085, as well as add 17 <br />new acres, totaling approximately 36 acres. Subsequent to the issuance of M-2006-032, the Operator <br />will pursue termination of M-1977-085. Therefore, this inspection occurred to verify that mining activities <br />have been confined to lands previously covered by the approved reclamation plan and bond for M-1977- <br />085, but has not yet commenced in the new lands addressed under M-2006-032. Three photos and copy <br />of the above referenced program policy accompany this report. <br />Mine identification sign and permit boundary markers were posted. As shown in the photos, mining <br />activities for M-1977-085 were appropriately confined to previously permitted areas and covered by the <br />existing reclamation plan and bond. Affected lands appeared stable and well managed; mining and <br />reclamation activities were compliant with permit conditions and the Act and Rules. Mining activities had <br />not commenced in the new lands addressed under M-2006-032. <br />Ellison Gulch, located approximately 400 feet south of the permit boundary, appeared to be infested with <br />knapweed. Serious weed pests were not observed within the boundaries of affected lands. Given the <br />proximity of the Ellison Gulch weed infestation to the permit area, the absence of such within the affected <br />lands suggests that the Operator has diligently employed weed control methods in accordance with Rule <br />3.1.10(6). The application for M-2006-032 includes a weed control plan, which appears to anticipate the <br />potential for weed invasion to affected lands and provides an appropriate monitoring and response plan <br />to deal with serious weed pests. <br />During the inspection, the Operator provided proof of renotice and proof of republication for M-2006-032, <br />in accordance with Rule 4.1(2) and the above referenced program policy.
