III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the New Horizon Mine conducted on June 6, 2006 by Mike <br />Boulay of the DMG. Ross Gubka of Western Fuels-Colorado (WFC) was present during the <br />entire inspection. Weather conditions were sunny and hot. Ground conditions at the mine site <br />were very dry. The current active pit area (Mine Cut 78) was inspected. At the time of the <br />inspection, drilling, overburden removal and coal hauling activities were all ongoing. Two <br />dozers were working in the pit to remove overburden from a cast blast that was shot yesterday. A <br />shovel and truck were also working on a new cut on the bench above the current pit to remove <br />overburden. <br />Availabiliri of Records <br />All required records were on site and available for review. Please see the attached records <br />checklist at the end of this inspection report. <br />Roads <br />Haul roads and access roads were in good condition throughout the site. <br />Hydrologic Balance <br />Sedimentation Ponds 007, 008, 009, 012, and 014 were viewed during this inspection. Pond 007 <br />was the only pond dischazging. The majority of dischazge from outfa11007 is the result of water <br />being pumped from the pit. Less groundwater has been encountered in the current pit than in <br />some of the previous pit areas. Approximately 250 gallons per minute were being pumped from <br />the active pit to Pond 007. Pond 008 was retaining a significant amount of water but was not <br />dischazging. Ponds 009, 012, and 014 were dry. <br />Support Facilities <br />The surface facilities azea was inspected. The site was maintained and no problems were noted. <br />
