<br />We will clean up the remainder of scrap in the spring of 1996 <br />when the thaw allows us to do so. There is also some oil <br />contaminated soil that will be removed in the spring. We use <br />only one tank for our fuel needs. It is surrounded by a <br />containment berm. The other tanks present are empty and not <br />being used. Corrective action is necessary here, but since <br />the inspection report came 11 weeks after the inspection this <br />action cannot be done until spring and is impossible to complete <br />in seven days. <br />PB-4 A diesel generator, 55 gallon fuel tank, and pump <br />are located adjacent to the Middle Fork of the South <br />Platte River. There is no spill containment structure <br />for the fuel tank and the ground along 'the bank of <br />the Middle Fork as been stained form fuel spillage. <br />Corrective action: The contaminated soil will need <br />to be removed and properly disposed and the fuel tank <br />must be placed in a spill containment structure in <br />order to minimize disturbances to the quality of <br />surface and ground water Verification must be <br />submitted to the Division in the form of photographic <br />evidence and a copy of the bill of lading or receipt <br />for the contaminated soil from an approved landfill <br />In no later than December 12, 1995. <br />When Mr. Curtiss pointed out this problem to me on September <br />28, 1995, I immediately removed this fuel tank, emptied it into <br />the 10,000 gallon fuel tank that has an embankment and removed <br />the fuel contaminated soil. I told Mr. Curtiss that the tank <br />will not be used again at its original site until spring of <br />1996. At that time it will be enclosed by a soil containment <br />berm. <br />PB-5 The operator does not have a stormwater permit or <br />verification that one is not needed. <br />Corrective Action: Submit verification to the Division <br />that a stormwater plan has been filed with the Depart- <br />ment of Health (or verification that one is not needed <br />no later than December 12, 1995. <br />2 have ascertained that a storm water permit is necessary <br />and have asked Tuttle and Applegate to prepare an application <br />for such a permit. However it is impossible to complete in <br />seven davs. <br />Mr. Curtiss has observed that the sediment pond is 18-19 <br />acres. I measured it to be less than 3 acres. Tuttle and <br />Applegate will measure all disturbed areas and include these <br />areas in a map with the application for amendment. <br />-4- <br />
