This permit covers a placer <br />mine near the town of Fairplay. The Division last inspected <br />the mine in May of 1993. There had been no activity at the <br />site until we took over in April 1995. From April through July <br />of 1995 we worked on establishing a new wash plant in the mine <br />and generally cleaning up the mess that M & M Mining left behind. <br />On or about August 1st the mine went back into production. <br />We mined for only 60 days, since we had contracted to build <br />a landfill in Weld County during the fall and winter of 1995-96. <br />During those 60 days Zigan Sand & Gravel, Inc, merely made deeper <br />the excavation that M & M Mining had begun. We did not enlarge <br />the area of excavation. <br />On Sept. 28, 1995, our last day of production for 1995, <br />Gary Curtiss of the Division made an inspection of the site. <br />This inspection was undertaken because of an adjacent property <br />owner complaint about engine noise. <br />On December 12, 1995 the Division mailed the inspection <br />report to Zigan Sand & Gravel, Inc.. We received it on December <br />15, 1995, note, it took 11 weeks from the date of the inspection <br />until we received the report. I have two great difficulties <br />with this report. One: It is based on faulty observations and <br />two: The time given for corrective action is seven days from <br />the date received. <br />I will comment on each of the problems /possible violations <br />contained in the report. <br />PV-1 The active pit is approximately 6 acres in size <br />and concurrent backfilling and reclamation were not <br />being done pursuant to the approved mine plan. <br />10800 East 124th Avenue • Brighton.
