<br />MINE ID # OR PROSPECTING ID # <br />INSPECTION DATE 7/18/95 <br />(Page 2) <br />N-77-439 <br /> <br />INSPECTOR'S INITIALS ACS <br />This inspection was conducted in response to a complaint from Mr. John Glass, owner of the <br />I.C. Woods Seepage Ditch. The complainant states that the I.C. Woods Seepage Ditch rune <br />through Western Mobile's permit area, and that water conveyance structures of the I.C. Woods <br />system have been damaged by Western Mobiles operations. it ie clear that the I.C. Woods <br />Seepage Ditch does cross the permit area through the pit designated "are~i J^ in the 1987 <br />permit amendment. The I.C. Woods ditch now rune along the crest of a dike that has been <br />constructed in the center of the pit. The I.C. Woods Seepage Ditch may croeia the permit area <br />in other locations ae well. <br />Rule 6.4.3(q) of the Mineral Rules and Regulations requires permit applica.nte to: <br />Show the owner's name, type of etructuree, and location of all permanent <br />or man-made etructuree contained on the area of affected. land and within <br />two hundred (200) feet of the affected land. <br />The section of the I.c. Woods Seepage Ditch crossing pit area J ie on the area of affected <br />land, but ie not identified in the permit. There may be other locations where the I.C. Woods <br />system crosses the permit area. The operator will be required to comply w:~th Rule 6.4.3(g) <br />by mapping the I.C. Woods Seepage Ditch in all locations where it ie on the affected land or <br />ie within 200 feet of the affected land. Also, in accordance with Rule 6.4.3(g), the <br />operator must describe the I.C. Woods Structures, and provide ownership information. The <br />maps and other information must be incorporated into the permit as a technical revision. The <br />Division requests that the technical revision be submitted in duplicate. <br />The Mined Land Reclamation Act, in Section 34-32-115(4)(d) states that: <br />The mining operation will not adversely affect the i;t ability of any <br />significant, valuable, and permanent man-made etructuree located within two <br />hundred feet of the affected land, except where there is an agreement <br />between the operator and the persona having an interest in the structure <br />that damage to the structure ie to be compensated for bl• the operator. <br />In accordance with 34-32-115(4)(dj, the operator must include in the required technical <br />revision, a demonstration that the I.C. Woods Seepage Ditch has not been,, and will not be <br />adversely affected by the mining operation, or, alternatively, must include: documentation of <br />an agreement with the owners of the I.C.
