III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
The two-track road associated with the old topsoil stockpile located adjacent to the lower Munger
Canyon access road, just to the east of the road crossing of Munger Creek, has developed some rilling. A
series of water bars should be constructed along the two track road to prevent further rilling.
Revegetation
Initial stabilization seeding was completed in portions of the waste disposal area disturbance in
November, immediately following completion of construction, but the seeding was not completed due to
significant snowfall in late November/early December. Snow cover persisted for much of December and
January due to cold temperatures and periodic snowfall. Remaining stabilization seeding and straw
mulching in the waste disposal area vicinity was completed as weather and ground conditions allowed in
February and March. Some very recent grass emergence was observed•on.south facing slopes of the
topsoil stockpile during this inspection. :.
Wildlife ... . :, ..
There was a:high density of:elktracks and droppings along lowecsections of the Munger Canyon road, in
the vicinity of the waste disposa4area. ..... ,
Offsite Support Facilities
As previously noted, cleanup of coal fines along the Loma Loadout access road had been initiated;
.l~ .. -..
additional work~is•warranted and has been scheduled. ~ :- - - ~~ °^'~ =• -
Sediment.controls.for the.disturbed•area at the loadout were.functional.<The disturbedcarea.wasseeded
and mulched for a second time in November 2004. The original seeding had failed during the recent
period of abnormally dry growing seasons. Winter and early spring moisture has been somewhat above
normal this year, and some very recent emergence of grasses was noted during the inspection. It could
. not be determined whether..the seedlings were annuals, or the seeded perennial wheatgrass._:There was
no emergence of the seeded shrub species evident. ~ --:~ <•.. -s; .: ::: :~ ..: .:~;.•.,~,:, ,:
.. , c'r -
7
