III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Signs and Markers <br />New Permit I.D. signs identifying Central Appalachia Mining, LLC as permittee had been installed at both <br />the mine area entrance gate off Highway 139, and at the Loma Loadout, as requested. A couple stream <br />buffer zone signs had been erected at both ends of the topsoil stockpile at the coal mine waste disposal <br />area. At least one additional stream buffer marker should be erected on the north side of the topsoil <br />stockpile. Also, a topsoil stockpile sign needs to be erected on this same stockpile. <br />Roads <br />The lower section of the road was in good condition, the surface in the vicinity: of the waste disposal site <br />was moist but not muddy. •• <br />The newly-constructed sectidn`~6f'rdad'in'"the vicinity of the coa6mine waste disposal~area'will need to be <br />gravel surfaced as soon as practicable; and prior to any further waste haulage: Drainageifrdm4he~entire- <br />segment of new road is directed by=collection ditches into the waste disposal atea sedimentpond;•im <br />accordahce with permit designs.= ' <br />Culvert CMP-3, which should have been installed in conjunction with waste disposal area drainage system <br />construction, was not installed. See narrative above regarding NOV CV-2005-004. The culvert should <br />have been installed beneath the Munger Canyon access road, immediately east of the east end of the re- <br />aligned waste dispdsal haul road segment. <br />Disturbances associated with the'waste disposal area road disturbance had,been properly-seeded and <br />mulched since the previous inspection. <br />To the east of the waste disposal site, near the lower end of the "canyon section" of the access road, <br />the road was blocked as a result of a recent small slough from a steep roadcut, which brought down a <br />couple large juniper trees and several sizable sandstone boulders; as wallas a-small quantity of soil: l <br />was not able to drive around the'trees-'and rock, and as a result was unable to access upper sectibnsof <br />the road and the portal bench area. The debris blocking the road needs to be cleared as soon as <br />practicable. The remainder of the road needs to be checked and maintained as needed. <br />At the Loma Loadout, clean up of coaly material along the entrance road had been initiated as requested, <br />but the project was not yet completed. Walter Whitledge indicated that additional clean-up would be <br />undertaken within the next several days, and that additional gravel surfacing would be laid down along <br />the entrance road. <br />Hydrologic Balance <br />There was significant flow in East Salt Creek, and minor flow in Munger Creek. <br />At the coal waste disposal area, snow had completely melted since the previous inspection. The sediment <br />pond bottom was muddy but there was no standing water. Collection and diversion ditches and culverts <br />were (with the exception of CMP-3) were in place and functional. A temporary crossing had been built <br />across collection ditch "I" to allow vehicle access onto the cover soil stockpile, to distribute straw bales <br />for mulch spreading. The mulching project has now been completed. There is still considerable capacity <br />5 <br />
