<br />Cease and Desist Order: None <br />Corrective Actions(s): 1) Submit verification that the spray evaporative system meets the <br />capacity as designed by Richard Fox and approved by the Division <br />no later than October 15, 1997, and is in operating condition. <br />2) An efficient screen and filter for recirculating pump intake must <br />be placed fully enclosed within a screen inside a coarser screen or <br />filter to the Division's satisfaction no later than October 6, 1997. <br />3) Operator will operate the spray evaporation and land application <br />systems to remain in compliance with permit conditions. <br />4) Provide a modification to permit M-94-117 within 30 days of the <br />Board hearing that includes a plan to provide adequate process <br />water storage capacity at the Gold Hill Mill. Such plan must be <br />approved by DMG no later than 60 days from the date of submittal. <br />CIVIL PENALTY <br />A person who violates any provision of a permit issued under C.R.S. 34-32-101et. seo• shall be <br />subject to a civil penalty of not less than $100 per day, nor more than $1,000 per day for each <br />day during which such violation occurs. Any operator who operates under a permit issued <br />under section 34-32-110 shall be subject to a civil penalty of not less than fifty dollars nor more <br />than two hundred dollars per day for each day during which such violation occurs (C.R.S. 34- <br />32-124(7)). <br />Duration from April 1, 1997 -May 10, 1997 = 40 days <br />$50.00 - $200.00/day x 40 = $2,000.00 - $8,000.00 <br />SUSPIENSION OF CIVIL PENALTIES <br />The Board may suspend all or a portion of the civil penalty to encourage timely compliance with the <br />corrective actions, and compliance with the Act and Rules and Regulations. <br />The Board may also suspend all or a portion of the civil penalty based on the permittee's efforts to <br />correct the violation(s) prior to the Board hearing. The permittee has completed the following actions <br />as of Ivtay 10, 1997, in order to correct the listed potential violation(s): <br />Installed and operated tailings pond evaporation system and land application system by May <br />10, 1997. <br />4 <br />
