Aeclama.tion Problem: Mining and rec lama[ion permits issued by the State of Colorado are <br />open-ended and do not have an enforced end date Eor mining and reclamation. As long as the <br />site is being actively mined and reclaimed in conformance with the approved permit and with <br />State Statutes, then [he permit can remain active for an indefinate period of time. <br />Unattendec problems, as identified and confirmed by the Division, may lead to enforcement <br />actions and even permit revokacion in extreme cases. Operators are required to complete each <br />phase of final reclamation within five years after the date on which the operator advises the <br />Mine Land Reclamation Board that such phase has commenced, unless such period is extended by <br />the Board. Certain disturbed areas noted by Mr. Cox may be either part of the on-going <br />mining operation and not yet subject to reclamation, or reclamation in progress that has not <br />yet reached the 5th year Following initiation of reclamation. <br />7. Future 17ining Plans: Mining and reclamation permits may be amended as many times as needed <br />in order c~~ comply with the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials and the Construction Material Rules and Regulations. Aggregate Industries, Inc. <br />is currently an operator in good standing with the Division of Minerals and Geology; and as <br />such, may :.~o ld as many permits as they wish, provided they comply with all applicable rules <br />and regulations and post sufficient bond to cover the cost of reclaiming all the sites for <br />which they have permits to mine and reclaim. An amendment to this permit may be submitted <br />by Aggregate Industries, Inc. for the conveyor belt as specified by Mr. Cox. During such <br />amendment process, members of the public (including Mr. Cox) will have the opportunity to <br />comment on the proposed corridor and express their concerns. <br />8.
