III. COMMENTS -COMPLIANCE <br />Below are comments on the rnspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the Facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine is in permanent cessation and <br />reclamation of most areas is complete. Patchy snow covered the ground and access was <br />limited to the main facility reclaimed area and the coal loadout. The weather was sunny and <br />mild. <br />Availability of Records <br />The public copy of the mine records is kept at the Energy Fuels Coal Company office in <br />Florence Ground water sampling was conducted in November 2006. The required liability <br />insurance certificate indicated an expiration date of October 1.2007. Pond inspections and <br />refuse pile inspections for the 3'd quarter should be filed with the public copy of the records <br />as soon as possible. More details regarding the records inspection can be found on page 2a <br />of this report. Litter cover from previous <br />growth is significant. More recently revegetated areas show no sign of rills or gullies. <br />
