III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals <br />and Geology. Tom Bird represented the operator. The ground was wet. With the operator's consent, <br />this report was issued from the Denver office. <br />Availability of Records <br />All required records were available. <br />Signs and Markers <br />A mine i.d. sign was properly displayed at the entrance to the site. Disturbed azea boundary mazkers <br />were in place azound the perimeter of the facilities area <br />Roads <br />The mine entrance road was well maintained. <br />Hvdroloeic Balance <br />The water levels in both ponds were more than 4 feet below discharging. The east pond principal <br />spillway culvert was clear (it extends from the east pond, underneath the road, and out into the pasture <br />in Hay Gulch). Embankments and inslopes of both ponds were in good shape. The primary and <br />secondary spillways appeazed in good condition on both ponds. The operator is seazching for a <br />contractor to clean out the west pond. <br />The diversion ditches on either side of the surface facilities azea were in good condition. <br />Processine Waste <br />The waste pile showed no evidence of structural instability. The top of the pile was dry. The ditch <br />noted in last month's report as needing reshaping to ensure positive drainage is on the southwest side of <br />the pile, not the southeast side as mistakenly written in that report. The ditch has been reshaped since <br />last month, but needs further work to ensure positive drainage. The operator's representative has this <br />work on their maintenance schedule. <br />Supaort Facilities <br />Fuel tanks in the surface facilities area show no signs of leaks or spills, and have adequate spill barriers <br />in place. No problems were found in the surface facilities area. <br />
