III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. the comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />culverts were clear and appeared to be functioning properly. The second culverts <br />are about 200 yards below the first <br />two culverts. There is one-36" culvert and one-12" culvert. The runoff from these <br />culverts goes to pond D. These culverts were also clear and appeared to be <br />functioning properly, <br />Backfillina and Grading: The backfilling and grading in the Marr Pit area was <br />inspected in response to a Phase I Bond Release application received by the division. <br />The Marr Pit consists of two different areas. The first area is west of the permanent <br />access road. This is the area where overburden was removed and coal was <br />extracted. The second area is a small (less than ten acres) area east of the <br />permanent access road. This area was not disturbed by mining (no overburden was <br />removed). The Marr Pit area that was backfilled and regraded appears to have <br />been completed in accordance with the approved reclamation plan. A <br />comparison of premining and postmining topography maps from the permit (Map <br />35a and Map 37a, respectively) and the Actual Reclaimed Topography Map (Map <br />47) shows that the Operator has achieved Approximate Original Contour (AOC), in <br />accordance with Rule 4.14.1(2)(a). The inspection confirmed that AOC has been <br />achieved. There was no observable cracking in any of the backfilled areas or the <br />area where the highwall has been backfilled. With one minor exception noted <br />below, the Marr Pit area was free of any erosional problems. <br />Revegetation/Reclamation Success: The entire mine site has been revegetated. The <br />vegetation in the Marr Pit area is not as dense as that in the other areas but there <br />does not appear to be any problem with erosion. Vegetation is beginning to grow in <br />the rill and gully area that was recently fixed in the Marr Pit Area. The vegetation at <br />the loadout is growing nicely. There are no erosional problems at the loadout. <br />The reclaimed areas appear to be in good condition and are recovering nicely since <br />the grazing that was done in May/June. The six dead cattle in and around pond A <br />have been removed from the site. <br />Slides and Damaae: The area in the Marr Pit that was reworked because of erosion <br />has been reseeded. It appears to be stable at this point. The rill and gully areas in Pit <br />1 also appear to be stable. These areas will be monitored for continued stability. <br />
