III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by DMG staff from the Durango <br />Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The permit <br />was revoked; financial warranty was forfeited and utilized for final reclamation. <br />Site appeared stable. No individuals were contacted no activities were observed during the <br />inspection. Vegetative cover was well established for reclaimed areas not redisturbed by the <br />landowner. Vegetative cover for areas disturbed by the landowner after completion of <br />reclamation was sparse and weedy. <br />Sediment pond was dry, no discharge noted. Primary spillway for the sediment pond had <br />previously been removed by the landowner. <br />Evidence of erosion was observed in the portion of Coal Gulch, which had been realigned by the <br />landowner after completion of reclamation. Sediment, from the eroded portions of Coal Gulch, <br />was observed in the concrete culvert under Hwy 160. Site conditions suggest that erosion of the <br />realigned portion of Coal Gulch will continue. <br />
