Lochhead <br />Executive Direnor <br />Michael 8. Long <br />Orv¢ion Direcbr <br />During the Division's September l 1, 1996 inspection, two problems were noted. We have received a copy <br />of a letter from Rio Blanco County's Department of Development, regarding the overburden placed on the <br />right-of--way of County Road No. 8, and from the White River Electric Association, Inc., concerning their <br />power poles adjacent to the gravel pit. <br />The Division considers Problem 1 of the inspection, concerning the power poles, to be adequately resolved. <br />After examining the County's letter concerning the overburden placed on the County Road No. 8 right-of- <br />way, it does not appear that the County wishes the material to permanently remain on the right-of-way and <br />that it was not placed there with their approval. <br />Since the material was placed outside the approved permit area as part of your mining activities, the <br />Division believes that you may be in violation of the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials. Section 34-32.5-116(4)(1) of the Act states that "Areas outside of the affected <br />land shall be protected from slides and damage occurring during the mining operation and reclamation", <br />and Rule 3.1.5(3) of the Construction Materials Rules and Regulations states that "All grading shall be <br />done in such a manner to control erosion and siltation of the affected lands, to protect areas outside the <br />affected land from slides and other damage". <br />A formal "Reason to Believe a Violation Exists" letter will be sent to you under separate cover. <br />Since the Division has the original of the inspection report, I am returning your copy which you sent with <br />your response letters. <br />Sincerely, <br />Greg~~~~ g R~Squir <br />Environmental ProPro e eciali <br />on p st <br />GRS(gaw <br />Encl.: Copy of Inspection Report <br />M.\w\gawVm~rn.gn <br />
