BANTA, Director ~ <br />September 7, 1988 <br />Mr. Joe Dodge <br />Penn Mountain Mining <br />1226 Elm Avenue <br />Canon City, Colorado 81212 <br />RE: Bullger Basin Placer Status <br />(File M-85-022) <br />Dear Mr. Dodge: <br />On July 20, 1988, the Division conducted an inspection of the Bullger Basin <br />Placer operation. In the inspection report, which, we understand, you have <br />copy of, a number of concerns were noted in regard to compliance 'th the <br />mining and reclamation plans, and the adequacy of the $13,225.00 financial <br />warranty. <br />Our specific concerns regarding the reclamation plan are that (1) ~COncurrent <br />reclamation, as addressed in the permit application is not occurring; (2) <br />there is a good chance that significant erosion may occur due to he extent <br />and condition of the disturbed land. We are also concerned that, ue to the <br />extent of disturbance and the difficulty of reclaiming an area at the 12,000 <br />ft. elevation, the $13,225.00 financial warranty is not sufficient to perform <br />the reclamation tasks required at this site. <br />Our specific concerns regarding the mining plan are that (1) we could not <br />determine whether mining operations were being conducted sequentia ly, as <br />described in the permit; (2) we could not determine whether or not the <br />operation uphill from the initial high pressure wash facility is o erated in <br />conjunction with the permitted Bullger Basin Placer; (3) we could not <br />determine whether operations were being conducted within the permi <br />boundaries; (4) we are concerned that a broken pipeline which is ischarging <br />water downslope from the southern-most pond, could lead to off site erosion <br />problems. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
