She ground <br />conditions were costly dry with soee Buddy conditions near the south end of the pit. floor. The area that the operator is proposing to include in the <br />pereit area by reeoving other acreage fra the existing pereit area, is flagged at the south end of the pit. This area is costly rangeland with grass <br />and several trees. There are two irrigation ditches crossing this area. <br />The pit wears to have toad recent activity including eining of gravel, backfilling and grading of sine face highwalls and topsoil replaceeent ts the <br />regraded slopes. Approz~eately 700 feet of highwall ts the north and east sides of the pit area have been regraded to 3:1 slopes and topsoiled. The <br />current tepsaii replaceeent does not yet Beet the one Foot depth rewireeent. The one acre pond specified in the pereit has been constructed ts the west <br />side of the pit and is holding several feet of water. Several ducks were observed ts the pond. Cattails are established crowd the pond edges and in <br />a few locations within the shallow pond, Thera is evidence of stock watering at the pond. <br />The approved pereit does not state the source of water for the pond or if the operator has adequate water rights to eaintain the pond. Proof of water <br />ri¢~ts or a well pereit should be subeitted to the Division to address this concern. <br />There is evidence that a einor aeount of sedieentatits has occurred just outside the southwest corner of the pereit boundary, but within the <br />landowner/penittee's pro{w!rty. The operator should install sae type of sedieent control at this location to prevent further sedieentatien outside the <br />pereit boundary. <br />The pereit boundary is well Barked with steel posts painted orange. However, the sine identificatits sign required by Rule 3.1.12 was not observed at <br />the sine and should be installed as required. <br />Sae thistle was observed ts site that appeared to have been sprayed with an herbicide. The operator skald continue to exercise weed ctstrol to avoid <br />infestations of noxious ar~d undesirable weedy species. <br />Changes to the Mined Land F'eclaeatia Act, due to the passage of Senate Bill 91-177 in 1991, included the reeova] of the SSOOD.00 bad cap for 110(2] type <br />pereits. All sine sites ..n Colorado are na required to be bonded for the actual cost of reclaeatia if, in the case of pereit revocatits and bond <br />forfeiture, the state were to put the reclaeatits work out for coepetitive bid. Review and recalculatia of the required bond for reclaeatits of this <br />operation will take place aver the next few etsths. A detailed estieatr of the recalculated cost, based ts the approved eining and reclaeation plans and <br />ctsdititss observed during the inspection, will be forthcaing. <br />In 1967, the U.S. congress aeended the Clean Hater Act to expressly include store water discharges fra industrial sites as rewiring Clean Water Act <br />ctstrols. In 1990, EPA i5~eed regulations that. require specific industrial activities to obtain pereits in order to discharge stop water fra their <br />facilities. Active and inactive eining operations where store water coves into contact with overburden, raw eaterial, intereediate protects, byproducts, <br />finished products or waste products located at the eining site are specifically included. The deadline to apply for a store water pereit was October 1, <br />1992. If a store water pereit far this sine has not yet. been obtained, the operator cost cake application for such a pereit as soon as possible.
