III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. No one represented the operator <br />during the inspection. <br />Roads <br />The operator was grading the sand off of the paved entrance road. The coal haul truck traffic was raising a little <br />dust. The road was in very good condition. The guard rail was installed. The graveled east entrance road was in <br />good condition. The east gate was open. The light use road along the railroad tracks was very muddy but was <br />passable. <br />Signs and Markers <br />The mine ID signs were up at the main entrance, east entrance and near the railroad tracks. The required <br />information on the signs was correct. <br />Facilities <br />There was very little stockpiled coal on site. Although coal haul trucks were unloading and railcars were being <br />loaded during the inspection, there were no indications of fugitive coal dust going offsite. <br />No problems were observed at the mine office and shop area, substation, material storage area and the loadout <br />structures area. There were no leaks at the fuel facility. <br />Hydrology <br />There was very little water in the east side sediment pond. The primary discharge tube gate was closed. The <br />emergency spillway was functional and the embankment and pond inslopes appeared to be stable. The west side <br />dugout pond was dry. The combination spillway was functional. <br />The straw bales and silt fence along the railroad track small area exemption were functioning properly. <br />However, the straw bales surrounding the drop culvert on the east side of the site will need replacing soon. <br />Topsoil Stockpiles <br />The east topsoil stockpile had a moderate vegetative cover. The stockpile's collection and diversion ditches were <br />functional. Topsoil signs were up. The vegetative cover on the west topsoil stockpile was good. The <br />collection/diversion berm was in place and the topsoil signs were up. <br />c:/word/terror/insp03 07 <br />
