III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. No one represented the operator
during the inspection.
Roads
The operator was grading the sand off of the paved entrance road. The coal haul truck traffic was raising a little
dust. The road was in very good condition. The guard rail was installed. The graveled east entrance road was in
good condition. The east gate was open. The light use road along the railroad tracks was very muddy but was
passable.
Signs and Markers
The mine ID signs were up at the main entrance, east entrance and near the railroad tracks. The required
information on the signs was correct.
Facilities
There was very little stockpiled coal on site. Although coal haul trucks were unloading and railcars were being
loaded during the inspection, there were no indications of fugitive coal dust going offsite.
No problems were observed at the mine office and shop area, substation, material storage area and the loadout
structures area. There were no leaks at the fuel facility.
Hydrology
There was very little water in the east side sediment pond. The primary discharge tube gate was closed. The
emergency spillway was functional and the embankment and pond inslopes appeared to be stable. The west side
dugout pond was dry. The combination spillway was functional.
The straw bales and silt fence along the railroad track small area exemption were functioning properly.
However, the straw bales surrounding the drop culvert on the east side of the site will need replacing soon.
Topsoil Stockpiles
The east topsoil stockpile had a moderate vegetative cover. The stockpile's collection and diversion ditches were
functional. Topsoil signs were up. The vegetative cover on the west topsoil stockpile was good. The
collection/diversion berm was in place and the topsoil signs were up.
c:/word/terror/insp03 07
