III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. The Rimrock Mine consists of approximately seven acres of reclamation. The <br />2005 growing season will be the twelfth (12) growing season after reseeding. The ground was <br />generally dry and the weather was mild. The landowners, George and Milton Montoya, were <br />feeding a small group of cattle outside of the permit area, immediately south of the gate at the <br />mine entrance. We discussed the status of the site and the potential for a future Phase III <br />bond release application being submitted to the Division for review. <br />Hydrologic Balance <br />The sediment pond at the site was again dry, although the site has received moisture at <br />various times over the winter according to the landowners. The embankment and outlet pipe <br />appeared normal. <br />Revegetation <br />The litter cover from previous vegetative growth was matted to the ground in places, indicating <br />a past snowpack of heavy, wet snow. As mentioned, cattle are being fed in the adjacent area <br />but were not observed on the reclamation. <br />Overall, the site appeared in good condition for the winter season. <br />
