,- <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />placed just west of the turn-around location to allow safe notice and retreat. <br />A specific Sanborn Creek Mine entrance gate is located approximately 850 feet to the west of <br />the wood barricade. The mine gate represents the point at which the Sanborn Creek Mine <br />permit boundary crosses the old State Highway 133. A proper Permit Identification sign was <br />located at this gate at the time of the inspection. <br />Both Permit Identification and Blasting Warning signs are required at the east entrance to the <br />Sanborn Creek Mine. Both signs were posted so as to provide effective and early notice to the <br />public that a coal mine and possible blasting activities are located to the west of the sign <br />locations. The wooden barricade is not amine-related structure; however, it does assist in <br />warning the public of potential hazards ahead, and it is located to allow safe and easy retreat <br />and turn around. While it appears that the permit boundary and entrance areas were effectively <br />posted, the Blasting Warning sign was moved during the inspection to the mine gate (located <br />approximately 850 feet to the west) to ensure precise compliance with the applicable sign <br />regulations. <br />While movement of the Blasting Warning sign ensures precise compliance with the regulations, <br />the benefit of providing early warning located near a convenient retreat and turn-around location <br />has been lost. Therefore, the operator is encouraged to post additional signs located at or about <br />the location of the wood barrier (on private ground along the roadside) to warn the public that <br />the surrounding ground is private property and that a mine exists ahead. The operator is also <br />encouraged to keep the east mine gate locked. <br />No violations were issued as a result of this inspection. <br />Any person who has requested an inspection may request in writing that the Administrator <br />informally review the Division's decision either not to inspect or not to take enforcement action <br />on the basis of an inspection with respect to any violation alleged by that person. The <br />Administrator shall conduct the informal review and report the results in writing to both the <br />person requesting the review and the alleged violator within 30 days of the Administrator's <br />receipt of the request for review. Informal review under Rule 5.02.5(2) shall not affect any right <br />to formal review under Section 34-33-124 of the Act or to a citizen's suit under Section 34-33- <br />135 of the Act. <br />
