The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEDfS/POSSIBLE VIOLATIONS <br />AND <br /> DATE <br />1. / PROBLEM: <br />The permit boundary markers installed by the operator do not PB or PV:PB <br />reflect the approve permit area of 3 acres in size. TOPIC(S):MP <br /> 11/30/04 <br />CORRECTIVE ACTION: <br />Amend the 110(2) permit application to properly reflect the <br />permit area of 3.8 acres. Currently, the markers delineate the <br />permit area to be 3.8 acres rather than the approved 3.0 acres. <br />Such amendment must be received by the Division on or before <br />November 30, 2004. <br />/ <br />2 <br />Y PROBLEM <br />. <br />: <br />The reclamation plan does not address reclamation of the PB or PV:PB <br /> <br />maintenance building. TOPIC (S):SF <br />- <br /> il/30/04 <br />CORRECTIVE ACTION: <br />Address the reclamation of the maintenance building in the <br />amendment application so that the Division can calculate a cost <br />to remove the structure. If the building is to remain as a <br />component of the postmining land use, then approval must be <br />documented by the local land use authority by November 30, 2004. <br />/ <br />3.V PROBLEM: <br />The mining and reclamation plan does not address the waste pile PB or PV:PB <br />created by the operator. TOPIC (S):P-a <br /> 11/30/04 <br />CORRECTIVE ACTION: <br />Address the creation and reclamation of the waste pile noted on <br />site. If the pile is to remain in place, the operator will need to <br />address reclamation of the cut slope in the channel to ultimately <br />achieve a 3h:ly slope. If this issue is not addressed by the <br />operator, then the Division will revise the reclamation cost <br />estimate to move the pile back to the cut slopes to achieve a 3h:ly <br />slope as so noted in the reclamation plan. This should be <br />submitted with item #1 noted above. <br />4./ PROBLEM: <br />The operator is utilizing water in the creek for the mining PB or PV:PS <br />operation, but has not submitted the appropriate documentation TOPIC(S):FiB <br />to the Division. 11/30/04 <br />CORRECTIVE ACTION: <br />Demonstrate that the operator is in compliance with the permit <br />and applicable Colorado Water Laws regarding the use and <br />exposure of water in the Cashe Creek by November 30, 2004. <br />
